A New Jersey woman who thought she had won the lottery is suing the television station that broadcast the incorrect winning numbers, The Record reported Saturday.
Rakel Daniele of Fort Lee, N.J., is seeking $75,000 in damages from WABC-TV American Broadcasting Co., the Walt Disney Co. and an unidentified "Jane Doe." The lawsuit says Daniele had a lottery ticket with the numbers 1, 2, 3, 4 and 5, and the New York ABC station broadcast those numbers as the winning numbers on June 19, 2009 with a prize of $250,000.
The lawsuit goes on to claim that the station "negligently, carelessly, recklessly and/or intentionally" rebroadcast the same incorrect numbers the next day and says Daniele was "severely damaged" by relying on the "false and incorrect" numbers.
Broadcasting the incorrect numbers twice, the suit says, went "beyond all possible bounds of decency" and was "atrocious, and utterly intolerable in a civilized community."
Daniele's attorney did not respond to The Record's request for comment. The attorney representing ABC said the company does not comment on pending litigation.
